Terms of Service

1. Agreement to Terms

By accessing and using Xynex Group's services, you accept and agree to be bound by the terms and provision of this agreement.

2. Services Provided

Xynex Group provides web development, hosting, email setup, DNS management, ecommerce solutions, and digital marketing services as described on our website.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to customers.

3. Payment Terms

All services are billed according to the pricing plans displayed on our website. Payment is due upon invoice unless otherwise agreed in writing.

• Monthly services are billed in advance
• One-time setup fees are due before work begins
• Late payments may result in service suspension
• All prices are in South African Rand (ZAR)

4. Service Level Agreement

We guarantee 99.9% uptime for hosting services. If we fail to meet this uptime guarantee, customers may be eligible for service credits as outlined in our SLA.

Support response times vary by service plan and are detailed in individual service agreements.

5. Intellectual Property

All custom development work becomes the property of the client upon full payment. Xynex Group retains the right to display completed work in our portfolio unless otherwise agreed.

Clients are responsible for ensuring they have proper licenses for any third-party content, images, or software used in their projects.

6. Client Responsibilities

Clients agree to:

• Provide accurate and complete information
• Respond to requests for feedback in a timely manner
• Make timely payments as agreed
• Use services in compliance with applicable laws
• Maintain backups of important data

7. Limitation of Liability

Xynex Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services.

8. Termination

Either party may terminate services with 30 days written notice. Upon termination, all outstanding fees become immediately due and payable.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
